Welcome to Affirmism, a sound healing and meditation app developed by Finding Home Healing (“we,” “us,” or “our”). By downloading, installing, or using Affirmism, you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the app.

1. Acceptance of Terms

By creating an account, checking the “I agree” box during onboarding, or otherwise accessing or using Affirmism, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. These Terms constitute a legally binding agreement between you and Finding Home Healing. If you are using the app on behalf of a minor, you accept these terms on their behalf and are responsible for their use of the app.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use Affirmism on Apple devices that you own or control, solely for your personal, non-commercial use. This license does not give you any ownership rights in the app or its content.

3. Intellectual Property & Audio Content

All content within Affirmism — including but not limited to binaural beat audio tracks, guided meditation recordings, sound compositions, music, artwork, design elements, text, and software code — is the exclusive property of Finding Home Healing and is protected by copyright and intellectual property laws.

You may not, under any circumstances: reproduce, copy, record, extract, rip, or download any audio files, binaural beats, or guided meditations from the app; distribute, share, upload, broadcast, or make any audio content available to third parties through any medium; sell, license, sublicense, rent, lease, or commercially exploit any audio content or other materials from the app; create derivative works based on our audio content, including remixing, sampling, re-recording, or incorporating our tracks into other compositions; use any technical means to circumvent protections or extract audio files from the app bundle; or use any content from the app in any commercial product, service, or public performance.

All original binaural beat compositions and guided meditation recordings are proprietary works created by or for Finding Home Healing. Unauthorized use constitutes copyright infringement and may result in legal action.

4. Your Content

When you record personal affirmations using Affirmism, those voice recordings remain yours. We do not claim ownership of your recordings. All user-generated content (voice recordings, written affirmation text) is stored locally on your device and is never uploaded to any server. You are solely responsible for the content of your recordings.

If you provide your name and email address during onboarding, this information may be transmitted to a third-party email service provider as described in our Privacy Policy, solely for the purpose of sending you occasional app updates and wellness content.

5. Acceptable Use

You agree to use Affirmism only for its intended purpose as a personal meditation and wellness tool. You may not: reverse engineer, decompile, or disassemble any part of the app; attempt to gain unauthorized access to any portion of the app or its systems; use the app in any way that violates applicable laws or regulations; or interfere with or disrupt the app’s functionality.

6. Health & Medical Disclaimer

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY.

Affirmism is designed as a wellness and relaxation tool. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The binaural beats, guided meditations, and affirmation tools are intended for general relaxation, personal development, and wellness purposes only.

The content provided through Affirmism does not constitute medical advice, mental health counseling, psychological treatment, or any form of professional healthcare. The app is not a substitute for professional medical advice, diagnosis, or treatment.

Binaural Beat Safety Warning: Binaural beats deliver specific audio frequencies to each ear through headphones, which may influence brainwave activity. If you have epilepsy, a seizure disorder, a history of seizures, or any neurological condition, consult your physician or neurologist before using this app. If you experience any unusual physical or mental discomfort, dizziness, nausea, headaches, or other adverse effects while using binaural beats, discontinue use immediately and consult a healthcare professional.

Do not use Affirmism while operating a motor vehicle, heavy machinery, or performing any activity that requires your full attention. Binaural beats are designed to alter your state of alertness and relaxation.

If you are experiencing a mental health crisis, suicidal thoughts, or any medical emergency, please contact emergency services (911) or a crisis helpline immediately. Affirmism is not equipped to provide crisis intervention or emergency services.

You acknowledge that you use Affirmism at your own risk and that Finding Home Healing shall not be liable for any health-related consequences arising from your use of the app.

7. Data Loss Disclaimer

All data created within Affirmism — including voice recordings, session history, preferences, and progress — is stored locally on your device. While we take reasonable precautions to protect your data through proper software engineering practices, we cannot guarantee against data loss. Data may be lost due to device failure, software updates, operating system changes, accidental deletion, or other circumstances beyond our control.

You are solely responsible for backing up your device and data. Finding Home Healing shall not be liable for any loss of recordings, session data, progress, streaks, or any other data stored within the app. We strongly recommend maintaining regular device backups through Apple’s iCloud or iTunes backup services.

8. No Warranty

AFFIRMISM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that: the app will be uninterrupted, timely, secure, or error-free; the results obtained from using the app will be accurate or reliable; any particular health, wellness, or personal development outcomes will be achieved; or any defects in the app will be corrected.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FINDING HOME HEALING, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF DATA, LOSS OF RECORDINGS, LOSS OF PROFITS, LOSS OF GOODWILL, PERSONAL INJURY, OR ANY OTHER INTANGIBLE LOSSES, ARISING FROM: (A) YOUR USE OF OR INABILITY TO USE AFFIRMISM; (B) ANY HEALTH-RELATED EFFECTS FROM USING BINAURAL BEATS, GUIDED MEDITATIONS, OR OTHER CONTENT; (C) ANY LOSS OF DATA, RECORDINGS, OR PROGRESS; (D) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; OR (E) ANY OTHER MATTER RELATING TO AFFIRMISM.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.

10. Indemnification

You agree to defend, indemnify, and hold harmless Finding Home Healing, its owners, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of Affirmism; (b) your violation of these Terms of Use; (c) your violation of any applicable law or regulation; (d) any content you create, record, or store using the app; or (e) any claim that your use of the app caused harm to you or any third party.

11. Assumption of Risk

You expressly acknowledge and agree that your use of Affirmism is at your sole risk. You assume full responsibility for any effects, whether positive or negative, that may result from listening to binaural beats, guided meditations, affirmations, or any other audio content provided through the app. You represent that you have consulted with a qualified healthcare professional regarding any medical conditions that may be affected by audio frequency technology before using the app.

12. Age Requirements

You must be at least 13 years of age to use Affirmism. If you are between 13 and 18 years of age, you may only use the app with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. By allowing a minor to use Affirmism, the parent or guardian agrees to be responsible for the minor’s use and to supervise their interaction with the app.

13. Termination

We may terminate or suspend your access to Affirmism at any time if you violate these Terms of Use. Upon termination, your license to use the app ends immediately. You may also stop using the app at any time by deleting it from your device. Sections regarding intellectual property, health disclaimers, limitation of liability, indemnification, assumption of risk, and governing law survive termination.

14. Changes to These Terms

We may update these Terms of Use from time to time. When we do, we will revise the “Last Updated” date at the top of this page. Continued use of the app after changes constitutes acceptance of the revised terms. We encourage you to review these terms periodically. If we make material changes that significantly affect your rights, we will make reasonable efforts to notify you through the app or via email.

15. Governing Law & Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Idaho, United States, without regard to its conflict of law provisions. Any dispute arising under these terms shall be resolved exclusively in the state or federal courts located in Idaho, and you consent to the personal jurisdiction of such courts.

16. Severability

If any provision of these Terms of Use is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms of Use, together with the Privacy Policy, constitute the entire agreement between you and Finding Home Healing regarding your use of Affirmism and supersede any prior agreements or understandings.

18. Apple-Specific Terms

These terms are between you and Finding Home Healing only, and not with Apple, Inc. Finding Home Healing, not Apple, is solely responsible for Affirmism and its content. Apple has no obligation to provide any maintenance or support services for the app. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple is not responsible for addressing any claims relating to the app or your use of it. In the event of any third-party claim that Affirmism infringes that third party’s intellectual property rights, Finding Home Healing, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of such claim. Apple and its subsidiaries are third-party beneficiaries of these Terms of Use and may enforce them against you.
